EXECUTIVE SUMMARY Summary of the Case In July 2006, Goliath entered an exclusive contract with Giant Theatres Inc. This contract granted the rights, license, and permission to display â€Å"Kombat Rex I-V†. In March 2007, Goliath Productions received a notice from Giant Theatres Inc. that â€Å"all monies previously paid were to be returned or they would file a lawsuit.† In Giant’s letter, they included a newspaper clipping from a movie theatre in Toronto, Canada that was advertising the â€Å"Kombat Rex Series† for showing the second week of February 2007. Summary of the Analysis According to the legal analysis of the contract between Goliath Productions and Giant Theatres, there are strong indications that there was a contract breach. Even though there was strong indications of a contract breach, Abrams Advisory Group did financial analyses of the contract for the fiscal year 2006. First, the expected minimum revenue for the Giant Theatres contract is $32,075,000. Second, by using G.A.A.P., the revenue recognized for the fiscal year of 2006 is $8,795,833. Third, the cash-flow recognized for the fiscal year 2006 is $5,000,000. Summary of Course of Action On the legal analysis of the contract between Goliath Productions and Giant Theatres, Abrams Advisory Group have found that Goliath Productions breached the contract. We would suggest to settle the case out of court by returning the last months’ worth of contractual fees back to Giant Theatres.
